It has not been demonstrated that the proposal would not add to existing
parking stress due to demand from future residents for on street parking,
resulting in harm to the highway network, contrary to Policies DM29 and
DM30 of the Croydon Local Plan (2018) and Policy T4 and T6.1 of the
London Plan (2021).

The proposed refuse arrangements would result in bins being left on the
street which would cause an obstruction and harm to the appearance of the
streetscene contrary to policies DM10 and DM13 of the Croydon Local Plan
(2018).

The proposal would result in harm to a protected tree due to incursion into
Root Protection Areas of the building footprint, and services and utilities
contrary to Policies DM28 of the Croydon Local Plan, G6 of the London Plan
and Paragraph 131 of the National Planning Policy Framework.

In the absence of a legal agreement, the development would not contribute
to sustainable methods of transport or restrict the building method to self
build. The proposal would fail to mitigate the harmful impacts of the
development and would be unacceptable in planning terms. The proposal
therefore conflicts with Policies T6 of the London Plan (2021) and Croydon
Local Plan 2018 policies SP8, DM29 and DM30; and the Environment Act
2021.
In reaching this decision the Local Planning Authority has sought to work in a
positive and pro-active manner based on seeking solutions to problems in the
following way:

To assist applicants the Local Planning Authority has produced policies and
written guidance, all of which is available on the Council's website and offers a pre
planning application advice service. The scheme does not comply with guidance
and no pre application discussions were entered into. The Council is ready to enter
into discussions with the applicants to assist in the preparation of a new planning
application via the Council's Pre Application process. The Local Planning
Authority's suggested improvements were not adopted by the applicant. The Local
Planning Authority delivered the decision in a timely manner.
