The proposed roof terrace by reason of its design, scale and position
would result in the introduction of an incongruous addition that fails to respect
the character and appearance of the subject building or wider terrace,
contrary to policies D3 (Optimising site capacity through the design-led
approach) and D4 (Delivering good design) of the London Plan (2021) and
Policy LP1 (Design Quality and Local Character) of the Hackney Local Plan
(2020) the relevant sections of the Residential Extensions and Alterations
Supplementary Planning Document (2009).

The proposed roof terrace at upper ground floor level, by reason of its
size, design and position, would result in loss of privacy and overlooking to
neighbouring windows and their amenity space that would result in an
unacceptable adverse impact on the amenity of the neighbouring occupiers,
particularly 91 Albion Road. As such the proposed development is contrary to
policy D1 (London’s form, character and capacity for growth) of the London
Plan (2021), policy LP2 (Development and amenity) of the Hackney Local
Plan (2020) and the guidance contained within Hackney Residential
Extensions and Alterations Supplementary Planning Document (2009).
