The proposed roof terrace and associated works, by reason of it's size, proximity to neighbouring habitable windows and lack of overlooking mitigation measures, would result in detrimental loss of privacy, overlooking and noise and disturbance impacts for neighbouring dwellings, contrary to policies LP2 'Development and Amenity' and LP58 'Improving the Environment - Pollution' of the Hackney Local Plan (2020) and policies D6 'Housing Quality and Standards' and D14 'Noise' of the London Plan (2021)

The proposed bed and breakfast use would not meet a specific identified need and the would inhibit opportunities to provide conventional C3 housing or E(g)(i) office space. As such, the development is deemed contrary to policies LP25 'Visitor Accommodation', LP12 'Housing Supply' and LP26 'New Employment Floorspace' of the Hackney Local Plan (2020) and policy E10 'Visitor Infrastructure' of the London Plan (2021).

The proposed development has failed to provide an energy statement or identify any measures to improve the energy efficiency of the site in relation to the change of use. As such the development has not demonstrated that it will achieve the maximum feasible carbon reductions and will therefore not contribute to mitigating climate change contrary to policy SI2 ‘Minimising greenhouse gas emissions’ of the London Plan (2021) and policy LP55 ‘Mitigating Climate Change’ of the Hackney Local Plan (2020).
