The proposed development, by reason of its failure to discharge 1m above the eaves of the listed building at 11-15 Great Eastern Street, results in harm to the amenities of adjoining occupiers from fumes and odour nuisance. Furthermore, the operation of the duct results in noise and disturbance, without the submission of an acoustic report to demonstrate compliance with the LPA's noise standards. The development is therefore, contrary to D14 and SI 1 of the London Plan 2021 and LP2 & LP58 of Hackney Local Plan 2033.

The proposed duct, by reason of its size, materials, positioning, and method of attachment to the listed building Pennybank Chambers at 11-15 Great Eastern Street, results in harm to the heritage asset and therefore, fails to conserve and enhance its significance. Furthermore, the application submission documents including the site location plan fail to adequately consider the listed building to which the unauthorised duct is attached. The proposal is, therefore, contrary to policies D3, D4, and HC1 of the London Plan (2021) and policies LP1 and LP3 of the Hackney Local Plan 2033 (2020) and the South Shoreditch Conservation Area Appraisal and Management Plan.
