The development would be contrary to policies LP14 B and LP19 B of the
Hackney Local Plan 2033 (2020) as the site is identified as being located
within the Stamford Hill Area Action Plan Area (AAP) and because of this
location fails to provide a 4+ bedroomed family sized dwelling unit at the site
as part of the proposed housing mix as required by these policies and as
required by the Draft Stamford Hill AAP (February 2024) (Reg 19 Stage).

The development makes no provision within the submitted scheme for any
biodiversity uplift at the site and is therefore contrary to the biodiversity aims
and objectives of policy G6 of the London Plan (2021) and policy LP47 of the
Hackney Local Plan 2033 (2020) which require such measures and also
contrary to government policy advice and recommendations relating to
biodiversity requirements for new development.

The application does not secure any legal mechanism for a S106
agreement in relation to car-free development, restriction on parking permits
(except blue badge), and a commuted sum payment relating to a carbon
offset penalty tariff (£5,737) for the development as required planning
obligations arising from the proposal.
