By reason of its inappropriate size, scale, and materials, the proposed dwelling would result in development that does not positively respond to natural features and other open space, and that does not enhance biodiversity. The proposal would, therefore, conflict with policies D3 (Optimising site layout through the design-led approach), D4 (Delivering good design) of the London Plan (2021), and policies LP1 (Design Quality and Local Character) and LP17 (Housing Design) of the Hackney Local Plan 2033 (2020).

The proposed development, by reason of the provision of an inappropriate form of access to the site, would result in the provision of housing with an unacceptable standard of occupation contrary to London Plan (2021) policies D6 (Housing quality and standards), and T2 (Healthy streets) and policies LP17 (Housing Design), and LP41 (Liveable Neighbourhoods) of the Hackney Local Plan LP33 (2020).

The proposed development, by reason of the lack of provision of affordable housing, would fail to adequately contribute towards the provision of mixed and balanced communities and housing needs in the local area. As such, the development would not be consistent with policies H4 (Delivering affordable housing) and H5 (Threshold approach to applications) of the London Plan (2021), Hackney Local Plan policies LP12 (Meeting Housing Needs and Locations for New Homes), LP13 (Affordable Housing), and the Hackney S106 Planning Contributions Supplementary Planning Document (2020).

In the absence of a suitable undertaking to secure that the occupiers of the new residential dwelling would not be able to apply for on street parking permit, the proposals would have an adverse impact on street parking conditions, highway safety and sustainable modes of transport, contrary to policies T1 (Strategic approach to transport) and T4 (Assessing and mitigating transport impacts) of the London Plan (2021) and Hackney Local Plan policies LP43 (Transport and Development) and LP45 (Parking and Car Free Development).

The proposed development, by reason of its size, siting and design, would result in an unacceptable loss of privacy and increased overlooking, detrimental to the residential amenities of neighbouring occupiers, contrary to policies D4 (Delivering good design) and D6 (Housing quality and standards) of the London Plan (2021) and policies LP1 (Design Quality and Local Character) and LP2 (Development and Amenity) of the Hackney Local Plan 2033 (2020).

The proposed development, by reason of a lack of sufficient energy efficiency measures and/or financial contribution towards carbon offsetting, would fail to achieve the maximum feasible reductions in carbon dioxide emissions, contrary to Hackney Local Plan (LP33) policies LP54 (Overheating and Adapting to Climate Change) and LP55 (Mitigating Climate Change), and policies SI2 (Minimising greenhouse gas emissions) and SI 4 (Managing heat risk ) of the London Plan (2021). .

The high probability of the failure of important trees on and adjacent to the site as a result of the proposed basement’s incursion into root protection areas, as well as failure to meet the mandatory BNG requirement, the loss of grassland, and the threat to protected species through construction and increased human disturbance without appropriate mitigation and compensation for this impact, the proposal is contrary to policies LP46 (Protection and Enhancement of Green Infrastructure), LP47 (Biodiversity and Sites of Importance of Nature Conservation), LP49 (Green Chains and Green Corridors) and LP51 (Tree Management and Landscaping) of the Hackney Local Plan (2020) and policies G1 (Green infrastructure), G4 (Open space), G6 (Biodiversity and access to nature), and G7 (Trees and woodlands) of the London Plan (2021).

In the absence of sufficient details to determine the extent of the basement excavation and the potential increased risk for groundwater flooding to the site and the surrounding area, the proposal is contrary to policy LP53 (Water and Flooding) of the Hackney Local Plan (2020), and policies SI 12 ( Flood risk management) and SI 13 (Sustainable drainage) of the London Plan (2021).
