Delegated decision: Refused · Lee Connor
Why it was refused
Reason
As stated on the decision notice
1
- The existing single storey rear extension by reason of its siting, height and rearward projection results in a
loss of outlook, overshadowing and an overbearing development to the occupiers of No.40 College Avenue, to
the detriment of their residential amenities, contrary to the National Planning Policy Framework (2023), Policy
D3 D.7 of The London Plan (2021), Policy DM1 of the Harrow Development Management Policies Local Plan
(2013) and the adopted Supplementary Planning Document: Residential Design Guide (2010).
2
-In the absence of a Noise Report, the proposal has failed to demonstrate that the existing air conditioning
units do not result in undue noise impacts on the occupiers of the adjoining properties No.38 and No.40
College Avenue, to the detriment of their residential amenities. The proposal is therefore contrary to the
National Planning Policy Framework (2023), Policy D3 D.7 and D14 of The London Plan (2021) and Policy
DM1 of the Harrow Development Management Policies Local Plan (2013).
