The proposed development would create a poor and sub-standard form of
residential accommodation in terms of the location of bedroom windows with no
defensible space, internal space standards and external amenity space provided,
at the detriment of the long term health and well-being for future site occupiers .
Therefore, the proposed development fails to comply with the requirements of
Policies D6 of the London Plan (2021) and Policy 56 and Policy 57 of the Waltham
Forest Local Plan Part 1 (2024).

The proposal fails to adequately address pedestrian safety and highway safety
in this location whereby there are existing concerns regarding the functioning of
the road and potential impacts on pedestrian safety. The proposal would be
detrimental to highway and pedestrian safety, as well as the well-being of future
occupiers, contrary to Policies 57, 61, 63 and 64 of the Waltham Forest Local Plan
Part 1 (2024).

The layout, in respect to limited pavement widths, no defensible space for
habitable rooms and poor siting with the existing cycle store, would create an
environment that appears unsafe and not improve safety and cohesion contrary to
policy 58 of the Waltham Forest Local Plan Part 1 (2024).

The proposal would create unacceptable waste management impacts, contrary
to Policies 57 and 93 of the adopted Waltham Forest Local Plan LP1 (2024).

Notwithstanding the above reasons, a S278 and S106 agreements are not
entered to ensure the development is in compliance with Policy DF1 of the
London Plan (2021), Policies 3, 46, 66, 85, 87 and 94 of the adopted Waltham
Forest Local Plan LP1 (2024), in relation to the following planning obligations
requirements:
Car Free Development - the development is to be classified as car-free and
residents will not be eligible for parking permits.
Financial contribution of £750.00 towards monitoring of the Construction
Logistics Plan
Financial contribution on any shortfall if 35% carbon reduction is not
achieved.
Financial contribution of £4,550.00 towards Strategic Access Management
and Monitoring Strategies (SAMMS) against mitigating the impact of the
development upon the Epping Forest Special Area of Conservation (SAC).
Monitoring Fee - A financial Contribution towards the implementation and
monitoring of and securing compliance with the s106, equal to 5% of the
total of all other financial contributions
Legal Fees - Payment of the Council's legal fees for the preparation and
completion of the Legal Agreement.
