The proposed development would, by reason of its siting, scale, form and
design, result in an inappropriate and unbulky addition that would fail to be
subservient to the host property and would be detrimental to the character and
setting of the existing dwelling and to this part of the Oxford Road Conservation
Area, resulting in less than substantial harm, with no identified public benefits to
outweigh the identified harm. The proposal therefore fails to comply with policies
LP1, LP3, LP5 and LP7 of the Wandsworth Local Plan (adopted July 2023), the
Housing SPD, and contravenes Section 72 (1) of the Planning (Listed Buildings
and Conservation Areas) Act 1990 and paragraphs 212 and 215 of the NPPF
(2024).

The development would by reason of its bulk, form and siting cause
unacceptable levels of overshadowing and an increased sense of enclosure to
adjoining properties. The proposal therefore fails to comply with policy LP2 of
the Wandsworth Local Plan (adopted July 2023), and the Housing SPD.

While a flood risk assessment has been provided, this fails to demonstrate that
the proposed runoff rate is equivalent to the greenfield runoff rate for the site or
that the existing runoff rate and demonstrate at least 50% betterment from the
existing to the proposed runoff rate. No basement impact assessment has been
provided. The proposal therefore fails to satisfactorily demonstrate compliance
with policies LP6 and LP12 of the Wandsworth Local Plan (adopted July 2023).
In dealing with this application the Council has implemented the requirement in
the National Planning Policy Framework to work with the applicant in a positive
and proactive manner and the Council has, as far as practicable, sought
solutions to problems arising in relation to dealing with the planning application.
We have made available detailed advice in the form of our statutory policies in
the Local Plan consisting of the Core Strategy, Development Management
Policies Document, Supplementary Planning documents and where appropriate
the Site Specific Allocations Document as well as offering a full pre-application
advice service. However, we have been unable to seek solutions to problems as
the principle of the proposal is clearly contrary to our statutory policies and
negotiation could not overcome the reasons for refusal.
