unduly overbearing and visually obtrusive, and result in loss of outlook and
increased sense of enclosure to the occupants of the second-floor rear-facing flats,
no.s 1 and 3, at the host site and of the C1 block in the Fosters redevelopment to
the detriment of the residential amenities of neighbouring occupiers, contrary to
Policy D3 of the London Plan (2021), Policy CS5 of the LB Barnet: Local Plan (Core
Strategy) DPD (2012) and Policy DM01 of the LB Barnet: Local Plan (Development
Management Policies) DPD (2012).

The applicant has failed to provide a satisfactory noise impact assessment to
demonstrate that the development would not result in unacceptable nuisance to
amenities of residents. In the absence of adequate mitigation measures, the
proposal would likely have detrimental impact on the amenities of the occupiers of
the surrounding residential properties. As such the proposal fails to comply with the
NPPF, Policy CS5 of the Local Plan Core Strategy and Policy DM01, DM02 and
DM04 of the Adopted Local Plan Development Management Policies DPD and
Sustainable Design and Construction SPD.
