The proposed residential development by virtue of its design, scale, bulk, siting and site
coverage would result in an overdevelopment and cramped form of development that is out of keeping
and character with the surrounding form and pattern of development and harmful to the visual amenity
of the locality. Furthermore, the excessive height would siting on the common boundary would
represent a dominant and incongruous feature within the street scene detracting from the established
character. The proposals are thereby contrary to Policies CP30 of the Core Strategy, GG1, GG2, D3,
D4 and D8 of the London Plan, DMD6, DMD8, and DMD37 of the Development Management
Document, as well as the guidance contained within the NPPF, which together seek to achieve a good
quality design.

The proposed development, by virtue of its size, design, scale, and relationship to site
boundaries would prejudice the development potential and prevent development on the adjoining sites
at no's 259 and 261 Green Lanes being optimised, detrimental to the future regeneration of this area.
In this respect the proposal would fail to comply with policies DMD6 and DMD8 of the DMD, GG1,
GG2, H1, H2 and D3 of the London Plan and the advice contained within the NPPF, which together
seek to achieve optimum potential for delivery of housing on brownfield land and small sites

The proposal has failed to demonstrate measures to promote and manage sustainable
drainage across the site which inhibits the ability of the Local Planning Authority to fully assess
whether the proposed development would result in an increase in flood risk on or off the site. The
proposal is therefore contrary to the advice contained within the NPPF, policies SI12 and SI13 of the
London Plan, policies CP21 and CP28 of the Enfield Core Strategy and policies DMD59, DMD60 and
DMD61 of the Development Management Document.

1 Paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 states that planning
permission is deemed to have been granted subject to the "biodiversity gain condition" which means
development granted by this notice must not begin unless:
(a) a Biodiversity Gain Plan has been submitted to the planning authority, and
(b) the planning authority has approved the plan, or
(c) the development is exempt from the biodiversity gain condition
The planning authority, for the purposes of determining whether to approve a Biodiversity Gain
Plan is Enfield Council.
If the onsite habitat includes irreplaceable habitat (within the meaning of the Biodiversity Gain
Requirements (Irreplaceable Habitat) Regulations 2024) there are additional requirements for the
content and approval of Biodiversity Gain Plans.
If this permission which has been granted has the effect of requiring or permitting the
development to proceed in phases. The modifications in respect of the biodiversity gain condition
which are set out in Part 2 of the Biodiversity Gain (Town and Country Planning) (Modifications and
Amendments) (England) Regulations 2024 would apply if the permission were subject to the
biodiversity gain condition. In summary: Biodiversity gain plans would be required to be submitted to,
and approved by, the planning authority before development may be begun (the overall plan), and
before each phase of development may be begun (phase plans).
