Back Garden: T1 Lime. Reduce selected branches to reduce height from approximately 6m to 5.5m. Back Garden: T2 False Acacia. Reduce selected branches to reduce height from approximately 7m to 5.2m. Council Note: The site has previously been associated with Tree Preservation Order records. However following inspection and review of the Council's records no evidence has been identified that the Order was confirmed and the Council does not therefore treat the site as subject to a valid Tree Preservation Order. The site is however located within the Stockwell Park Conservation Area. The notified works have been considered under section 211 of the Town and Country Planning Act 1990.

Crown thin by 15 percent and lightly cut back secondary growth encroaching over the boundary of No. 81 including removal of one long protruding branch growing over the garden. However following inspection and review of the Council's records no evidence has been identified that the Order was confirmed and the Council does not therefore treat the site as subject to a valid Tree Preservation Order. Rear Garden: 1 x Pear (T1): crown reduction by approx 40% to regenerate unhealthy looking areas of crown. Height from 4.0m to 2.4m. Crown Spread from 3.0m to 1.8m Rear Garden: 1 x Lime (T2): section fell to ground level. Height 15.0m. Crown spread 7.0m. Reason: (1) The size of the lime is too large and unsuitable for a garden. (2) Its close proximity (less than 10 cm) from the brick boundary wall, for which the council is responsible, threatens the integrity of the wall's structure and stability. (3) The number of dead branches also pose a threat to visitors to Slade Gardens, as several of them also hang over the public area. There are also a number of dead branches which hang over our garden as well, including close to a glass greenhouse. (4) There are very large sycamores on the public side of the wall which have not been maintained or pruned by the council, resulting in a dense cluster of trees and branches. (5) The large size of crown blocks most light from the pear tree, which has been significantly stunted as a result. Note: Tree T2 Lime is protected as T35 Lime under the London Borough of Lambeth (Stockwell Park) Tree Preservation Order No. 19 (1969). Consent for the proposed works to T2/35 Lime is refused. Tree T1 (Pear) is not included within the Order but lies within the Stockwell Park Conservation Area (CA5). The Council therefore accepts this element of the application as a valid Section 211 Notice of Intent to Carry Out Works to Trees in a Conservation Area and raises no objection to the proposed reduction works to the Pear.

We would like to remove the lime tree due to proximity to the boundary wall, which gives us concern not only for the stability of the wall that protects our property from Slade Gardens, but also due to the difficulty (if not impossibility) of constant care to remove the new growth on the lower trunk. In addition, the congestion above due to two other limes on either side of the side and boundary walls requires us to constantly keep the tree severely pruned. The area is already well shaded in that corner of our property and adjoining properties. We would like to replace the rear area with three apple trees to form part of an edible garden area we are creating at the rear of our garden.
